Terms & Conditions

These terms govern your use of Education Portal, operated by PJ Empire (Pty) Ltd. By signing an order form or onboarding a campus, you agree to these terms.

Service

We provide the Education Portal software-as-a-service on the tier specified in your order form, subject to the student cap and feature set of that tier. Uptime target is 99.5% monthly, excluding scheduled maintenance announced 48 hours in advance.

Fees and billing

Fees are quoted in ZAR and billed monthly or annually per your order form. Payment is due within 30 days of invoice. Annual invoices qualify for the published annual discount (equivalent to one month). Late payment attracts interest at the prime rate plus 2% per annum.

We will not back-bill for enrolment growth during a term. At renewal, we move you to the correct tier with one month's notice.

Acceptable use

You may not use the portal to harass, defraud, or unlawfully surveil students. Attendance records must reflect honest scans or deliberate lecturer overrides — not back-dated batch edits to inflate pass rates.

We reserve the right to suspend access on material breach, after 7 days' written notice to remedy.

Data ownership

You own your campus data. We hold it under a processor relationship. On termination, you get a full export in DHET-compatible CSV plus any uploaded learning material, within 30 days.

Warranties and liability

We provide the portal on an 'as is' basis, subject to the uptime target. Our total liability for any claim is capped at the fees paid in the preceding 12 months. We are not liable for consequential losses (e.g., missed NSFAS deadlines due to user error in data entry).

Termination

Either party may terminate on 30 days' written notice. On termination, all outstanding fees become due pro rata. Data export obligations apply as above.

Governing law

These terms are governed by the laws of South Africa. Disputes are resolved by the High Court of South Africa, Gauteng Division, unless both parties agree to mediation first.
